Alabama's Laws on Child Abuse and Neglect
Child abuse may be one of the saddest, most irresponsible actions a person can perform, but sadly, it happens every day. Laws concerning child abuse are intentionally broadly worded in hopes of prosecuting more offenders. In Alabama, child abuse is defined as any harm or threatened harm to a child's health or welfare through non accidental physical or mental injury or sexual abuse or exploitation. By this terminology, one never has to physically hurt a child, they only have to threaten injury. Also, anyone who reports child abuse does not need to have proof, they must only suspect it.
In the state of Alabama, pharmacists, social workers, law enforcement officers, day care workers, mental health professionals, members of the clergy (unless the action was revealed under privileged communication), or anyone else called upon to render aid or medical assistance to a child is required to report suspected abuse to the state Department of Human Resources immediately, or face a significant fine or jail time. When a report is made to DHR, they are legally required to investigate.
Under no circumstance is child abuse or neglect excusable. Conformity to these laws is necessary to protect and help those who cannot protect and help themselves.
